CPSIA and California AB1108 Compliance

We are working with all of our suppliers in an effort to comply with the CPSIA and AB 1108 regulations. Manufacturers are scrambling to complete testing on their products.  Some products cannot be tested because the manufacturer no longer has them in stock. In these cases, retailers may have them in their inventory. The action being taken for items that cannot be tested is the same for items that fail testing which adds to the confusion surrounding CPSIA and AB 1108. In addition, second hand stores and thrift shops are not bound by the CPSIA regulations which means that items that cannot be sold in new retail stores can still be sold in second hand and thrift shops.

We have pulled non-compliant products from our inventory. To ease concerns somewhat we want to inform you that our manufacturers are reiterating that these products are safe but unless tested, may not meet the new legal limits for phthalates. Phthalates are compounds added to plastic to soften it.

The good news is that we have only had to pull a handful of products from inventory.

CPSIA addresses lead content, choking hazards and phthalate levels for products that are intended for children 12 years and younger. They also address products that are not typically just for kids including music cds and books.

AB1108 addresses only phthalate levels.
